TERMS & CONDITIONS

Terms & Conditions apply to purchasing goods or participating in initiatives via our website. By registering on our website, you will be taken to have understood and agreed to be bound by these Terms & Conditions, and any future modifications to them. We reserve the right to change and update these Terms & Conditions from time to time and, while we endeavour to publish such modifications on a fully up-to-date basis, this may not always be possible. Please ensure that you understand all applicable Terms & Conditions before ordering goods or participating in initiatives. By continuing to access, browse and use this Website, you will be deemed to have agreed to any future modifications to our Terms & Conditions.

Age Restriction

In accordance with UK law you must be 18 years or over to register on our website, place an order or make a purchase of an item containing alcohol. By placing an order online or by phone you confirm that you are at least 18 years old. All deliveries must be signed for by an adult aged 18 years or over.

Processing Your Order

The display of products on our website represents an Invitation, but not an Offer, to sell these products.  An Offer is made when you place an Order for goods, and we accept it. Completion of the online checkout process does not constitute that we have accepted your order. Acceptance of your order will take place only at the time of dispatching it to you.

We will take payment from you shortly before dispatching your order.  However, we will not have made a Contract with you unless and until delivery or collection has taken place, irrespective of whether payment has already been accepted.  You will be asked for an email account when entering your payment details. We will email you to confirm that we have received your order and to notify you when we have dispatched it.

We reserve the right to refuse orders as we see fit.

Prices
Prices are quoted in £Pounds Sterling and are inclusive of Duty, Tax and VAT at prevailing UK rates. They apply per ‘unit’ i.e. one 75cl bottle, unless otherwise stated, and per stated Vintage (or like alternative Vintage). We will endeavour to advise you of any changes to Vintages and related cost implications.

We have taken all reasonable precautions to ensure that quoted prices are correct and that all products have been fairly described. However, please note that orders will only be accepted if there are no material errors in the price or description of the goods as advertised on our website. Should we mistakenly publish an incorrect price or incorrect product, we reserve the right to modify this to the correct price/product at the time of payment. We will endeavour to notify you of any such changes at this time.

While we endeavour to ensure all pricing is accurate and up-to-date, customers will appreciate that wine/alcohol pricing is subject to factors outside of our control, such as fluctuations in foreign exchange rates, Government taxes, duty and legislative changes. Therefore, we reserve the right to amend prices at any time and without prior notice, as we see fit.

Promotional offers and pricing are as stated, with no further discounts available.

Prices do not include any applicable delivery charges.

Special Offers
We reserve the right to alter the terms or remove altogether any Special Offers at any time and without prior notice, as we see fit.

Our monthly offering of ‘Staff Picks’ does not run in conjunction with any other offer and is strictly limited to stock availability.

All special offers/promotions do not run in conjunction with any other offers/promotions.

Minimum Orders

The minimum order quantity for craft beer is 6 bottles/cans.  This can be a case of one kind of craft beer or a mixed case. This minimum order requirement is waived if you are also purchasing wine and/or spirits.

There are no minimum order quantities on wine, spirits or liqueurs.

Product Availability
All items are subject to availability. While we endeavour to indicate accurate and up-to-date stock availability on our website, stock-taking discrepancies may occasionally occur. Additionally, availability may be affected by pertaining market conditions, production levels at the particular winery, shipping and import factors, and customer demand.

If the items you have ordered are not available, we will inform you as soon as possible and endeavour to offer an alternative suitable product, at an equal or higher price. We will advise you of any proposed substitutions, which you will be free to accept or decline. You will be charged for any higher priced substitutions.

If we cannot supply you with the ordered items or provide an acceptable substitution, we will not process your order and will inform you of this. If you have already paid for the item, we will refund you in full as soon as reasonably possible.

We reserve the right to remove any products, including Special Offers, at any time and without prior notice, as we see fit.

Vintages
We endeavour to list wines by their Vintage. However, there may be instances when a particular Vintage has come to an end and a new Vintage is released. We will endeavour to update our listings and pricings at such times. We will also notify you if the Vintage you have ordered is no longer available and discuss a suitable alternative with you where possible.

Payment
During the checkout process, you must complete all fields indicated as compulsory. Payment may be made by all major Credit or Debit Cards, or by PayPal. All card payments are subject to authorisation by your card issuer. Please note that we will collect and store your information, using an encrypted secure payment mechanism as facilitated by First Trust Bank and SagePay.

Completion of the online checkout process does not constitute that we have accepted your order. Acceptance of your order will take place only at the time of dispatching it to you. We will take payment from you shortly before dispatching your order.

All goods remain the property of The Sipster until we have received full authorised payment from you. If payment is not received but you have already received the goods, you must pay for the products or return them to us at your own expense in accordance with our reasonable return instructions and in the same condition that you received them. If you do not do this within 30 days of the date on which we cancel your order, we may collect or arrange for collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

Breakages
We have invested heavily in state of the art, inflatable bottle packaging in order to ensure all deliveries are received in perfect condition, however if for any reason breakages have occurred in transit, we will replace the damaged goods – provided you have examined the goods at the time of delivery and reported any breakages to the delivery driver. Subsequent claims for breakages will not be accepted if the goods were signed for and the delivery driver was not notified.

Returns

If you would like to discuss the exchange or return of any item, please email us at info@thesipster.co.uk or call us on +44 (0)28 9086 3206 between 11am and 7pm, Monday to Saturday.

Goods must be returned within 7 days of the date of despatch to be considered for refund or exchange. Refunds or exchanges will only be made once the goods are received. The goods must be in a saleable condition in their original, undamaged packaging; their overall condition will be considered when deciding whether a refund is applicable. Refunds will be paid using the same method that the original payment was made.

If a wine purchased from us is corked or faulty, we will offer a replacement or credit upon return of the bottle in question. Please note however, if a wine has been stored incorrectly or kept for too long, we may not be able to offer a refund.

Loss or damage of items in transit whilst being returned to us will be the responsibility of the customer unless the return delivery was arranged by ourselves using our approved courier.

Please note that the above requirements do not affect your statutory rights in the event of faulty goods.
